  • Consent to Application Sharing: Consent to their job applications being shared with third parties interested in contacting them about their applications.


Employer Responsibilities:

Employers agree to:

  • Compliance with Requirements: Comply with all requirements for job postings outlined in these terms.
  • Compliance with Laws: Comply with all applicable laws related to job postings and hiring practices.


Enforcement of Guidelines

Couriergigs reserves the right to enforce these guidelines and take appropriate action, including the removal of content, suspension of accounts, or legal action, for any violation of these guidelines. By using our site, you acknowledge and agree to abide by these conduct guidelines. Failure to adhere to these guidelines may result in the termination of your account and access to our platform.


Job Posting Guidelines

Employers using Couriergigs are required to adhere to the following guidelines when posting job listings on our platform. By posting job listings, employers agree not to post any jobs that violate these Terms of Service. Prohibited job listings include, but are not limited to:


Prohibited Job Listings:

Employers may not post job listings that include:

  • Listings for non-existent jobs.
  • Multi-level marketing opportunities (or "MLMs") or pyramid schemes.
  • Unpaid positions, focus groups, or survey opportunities.
  • Listings seeking to collect contact information for resale or any purpose other than hiring for the specific role outlined in the job posting.
  • Solicitations for sexually-oriented services or goods.
  • Content or links that contain any false or misleading information.
  • Content or links that are unlawful, defamatory, threatening, exploitative, obscene, lewd, violent, harassing, inappropriate, or objectionable or that do not relate to a legitimate job posting (for example, keywords that are not related to the job posting).


Compliance with Applicable Law:

Employers are responsible for ensuring that their job postings comply with all applicable laws, including but not limited to employment laws and non-discrimination laws.


Review and Rejection

All job postings and applications are subject to review by Couriergigs to ensure compliance with these Terms of Service. Couriergigs reserves the right to reject and remove any job postings or applications that violate these Terms.


Distribution and Removal:

Employers acknowledge that Couriergigs may be unable to remove job postings once they have been distributed to the public, partner job sites, or search engines. It is the responsibility of the employer to ensure the accuracy and compliance of their job postings before submission. By using our platform to post job listings, employers acknowledge and agree to abide by these guidelines. Violation of these guidelines may result in the removal of job listings, suspension of account privileges, or other actions deemed appropriate by Couriergigs.

MAXIMUM LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COURIERGIGS'S LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM WILL BE LIMITED TO THE AMOUNT YOU HAVE PAID TO COURIERGIGS, IF ANY, IN THE LAST 12 MONTHS.


INDEMNIFICATION

YOU AGREE TO INDEMNIFY AND HOLD COURIERGIGS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, LIABILITIES, AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF THE PLATFORM; (B) YOUR VIOLATION OF THESE TERMS; (C) YOUR VIOLATION OF ANY RIGHTS OF ANOTHER PARTY; OR (D) YOUR VIOLATION OF ANY APPLICABLE LAWS OR REGULATIONS.


GOVERNING LAW

THESE LIMITATIONS OF LIABILITY ARE SUBJECT TO THE GOVERNING LAW AS OUTLINED IN SECTION 10.

BY USING THE PLATFORM, YOU ACKNOWLEDGE THAT THESE LIMITATIONS OF LIABILITY ARE REASONABLE, AND YOU CONSENT TO THE TERMS OUTLINED IN THIS SECTION.


Dispute Resolution and Mandatory Arbitration

You and Couriergigs agree that any dispute, claim, or controversy arising out of or relating to your use of the platform, these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be settled by binding arbitration, except as otherwise expressly provided in these Terms.

The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA), or any other mutually agreed-upon arbitration service, in the English language, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.


Opt-Out of Arbitration

You have the right to opt-out and not be bound by the arbitration and class action waiver provisions set forth in these Terms. To exercise this right, you must notify us in writing within 30 days of the date you first use the platform or 30 days from the date the changes are communicated to you.


Class Action Waiver

You and Couriergigs agree that any arbitration or legal proceedings shall be conducted on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both you and Couriergigs waive any right to a jury trial.


Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the applicable laws, without regard to its conflict of law principles.


No Class Actions

To the extent permissible by law, all claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.


Equitable Relief

Notwithstanding the foregoing, either party may bring an individual action in small claims court or seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.


Severability

If any provision of this section is found to be unenforceable, then that provision will be severed from this section and not affect the validity and enforceability of any remaining provisions.

Opt-Out Options

If at any time you wish to opt out of specific types of communications or wish to unsubscribe from marketing communications, you may follow the instructions provided in our Privacy Policy or use the opt-out mechanisms provided in the communication itself.


Account-related Communications

Please note that account-related communications, including important updates and notifications related to your account, are considered essential for the proper functioning of the platform, and you may not be able to opt out of receiving such communications.

Termination


Termination by Couriergigs

Removal of Content

Couriergigs may also remove any content, including job postings or applications, if there is a failure to comply with these Terms or if you are engaging or have engaged in fraud or abuse on the platform.


Right to Appeal

In the event of termination or removal, you may appeal the decision by contacting us within 30 days of the action being taken. Appeals should be submitted to info@couriergigs.com. Couriergigs will review the appeal in a timely manner and may, at its sole discretion, reinstate access or content.


Effect of Termination

Upon termination of your account or access to the platform, you agree that all rights granted under these Terms will immediately cease, and you will cease all use of the platform.


Survival of Certain Provisions
